If that were the case, Fediverse hosts like masto.host would be in trouble.
You aren't required to support a free open source software. That's the "free" part.

Generally everything on the Fediverse is Free Open Source Software, like Mastodon.
Anyone can use mastodon software for what they see fit.
That's why Truth Social (and many other social media sites including the one you're on) can use Mastodon code without paying Mastodon Gmbh a single dollar.
